MilkSage

1. Introduction

Welcome to MilkSage. These Terms of Service constitute a legally binding agreement between you and MilkSage governing your access to and use of the MilkSage dairy farm management platform, including all features, tools, modules, and services offered through our website and application.

By creating an account, registering a farm, or using any part of the MilkSage platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform.

MilkSage is currently operated as a service primarily serving users in Pakistan. We intend to expand our operations globally in the future, and these Terms will be updated accordingly as that expansion occurs.

2. Who We Are

MilkSage is a software-as-a-service (SaaS) platform designed for dairy farm management. It provides tools for animal tracking, health management, breeding records, milk production monitoring, feed management, inventory control, financial recordkeeping, and employee payroll management.

3. Eligibility and Who May Use MilkSage

MilkSage is intended for use by individuals, businesses, and organizations involved in or managing dairy farming operations. This includes but is not limited to:

• Individual farm owners and operators
• Farming partnerships and cooperatives
• Agricultural businesses and companies
• Farm managers and employees acting on behalf of an authorized farm account

While we do not impose a formal minimum age requirement, MilkSage is a professional-grade farm management tool. By using the platform, you represent that you have the legal capacity to enter into binding agreements under the laws applicable to you, and that you are using the platform for legitimate professional or agricultural purposes.

You agree not to use MilkSage on behalf of any entity unless you have the authority to bind that entity to these Terms.

4. Accounts and Registration

4.1 Account Creation

To use MilkSage, you must create an account using a valid email address. Each email address may be used to register only one farm on the platform. Creating multiple accounts using different email addresses for the purpose of obtaining additional free trial periods is a violation of these Terms and may result in immediate termination of all associated accounts.

4.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, notify us immediately at admin@milksage.com.

4.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. MilkSage reserves the right to suspend or terminate accounts where information is found to be false, misleading, or outdated.

4.4 Team Members

Farm owners may invite team members to access the farm account under assigned roles. Farm owners are responsible for the actions of all team members operating under their farm account.

5. Free Trial

MilkSage offers a free trial period to new users upon registration. The following terms govern the free trial:

5.1 Duration

The free trial begins on the date your farm account is created and lasts for 14 days. During this period, you have full access to all features and modules of the platform at no cost.

5.2 Trial Period Changes

MilkSage reserves the right to modify the duration, terms, or availability of the free trial at any time. Changes to trial terms will not affect trials that are already active at the time of the change.

5.3 One Trial Per User

Each email address is entitled to one free trial. Creating additional accounts to obtain multiple trial periods is prohibited and constitutes a misuse of the platform.

5.4 After Trial Expiry

When your trial period ends, your farm account will enter a restricted state. You will retain read-only access to all your existing data. You will not be able to add new records, update existing data, or use any write functions of the platform until your subscription is activated. Your data is preserved in full during this period.

To continue using MilkSage after your trial, you must contact us to arrange payment and activate your subscription.

6. Subscriptions and Payment

6.1 Subscription Activation

MilkSage does not currently operate an automated online payment system. Subscriptions are activated manually after payment is received and confirmed by MilkSage. To subscribe, contact us at admin@milksage.com to receive payment instructions and available plans.

6.2 Payment Methods

Payments are accepted through local methods including but not limited to bank transfer, JazzCash, and Easypaisa. Payment details will be provided upon request.

6.3 Subscription Period

Subscription plans are offered on a fixed-period basis (for example, 30 days, 90 days, or 1 year). Your subscription period begins on the date your farm account is activated by MilkSage following confirmed receipt of payment.

6.4 Renewal

Subscriptions do not renew automatically. You are responsible for contacting MilkSage before your subscription expires if you wish to continue using the platform. MilkSage will make reasonable efforts to notify you before your subscription ends, but it is ultimately your responsibility to track your subscription status.

6.5 Price Changes

MilkSage reserves the right to change subscription pricing at any time. Price changes will not affect your current active subscription period. You will be informed of any price changes before your next renewal.

7. Refunds

7.1 Eligibility for Refund

MilkSage offers a full refund of your payment under the following conditions:

• Your refund request is submitted within 3 calendar days of the date payment was made, and
• Your farm account has not been activated at the time of the refund request

If both conditions are met, you are entitled to a full refund of the amount paid.

7.2 No Refund After Activation

Once your farm account has been activated and your subscription period has begun, no refunds will be issued regardless of how much of the subscription period remains.

7.3 How to Request a Refund

To request a refund, email admin@milksage.com within the 3-day window with the subject line "Refund Request" and include your registered email address and payment reference. We will process eligible refunds within 7 business days using the same payment method originally used.

7.4 Exceptional Circumstances

MilkSage may, at its sole discretion, consider refund requests outside the above conditions in cases of documented technical failure on our part that prevented meaningful use of the platform. Such decisions are made case by case and do not constitute a general right to a refund.

8. Data and Privacy

8.1 Your Data

All farm data you enter into MilkSage — including animal records, health data, milk production records, financial records, and employee information — belongs to you. MilkSage does not claim ownership over your farm data.

8.2 How We Use Your Data

We use your data solely to provide and improve the MilkSage service. We do not sell your data to third parties. We do not share your farm data with other users or farms on the platform. We may use anonymized, aggregated data for product improvement and analytics purposes.

8.3 Data Security

We take reasonable technical and organizational measures to protect your data from unauthorized access, loss, or misuse. However, no system is completely secure, and MilkSage cannot guarantee absolute security of your data.

8.4 Data Retention After Expiry

If your subscription expires and you do not renew within 90 days, MilkSage reserves the right to permanently delete your farm data. We will make reasonable efforts to notify you before data deletion occurs. MilkSage is not liable for data loss resulting from non-renewal beyond the 90-day retention window.

8.5 Data Export

You may request an export of your farm data at any time while your account is active. Contact admin@milksage.com to request a data export.

8.6 Privacy Policy

Our collection and handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Acceptable Use

By using MilkSage, you agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the platform or its underlying systems
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the platform
• Introduce viruses, malicious code, or any technology designed to disrupt or damage the platform
• Use automated scripts, bots, or scrapers to extract data from the platform
• Misrepresent your identity or impersonate any person or organization
• Create multiple accounts for the purpose of circumventing the one-farm-per-email policy or obtaining additional free trials
• Use the platform to store or transmit content that is illegal, defamatory, fraudulent, or harmful
• Resell, sublicense, or otherwise commercially exploit access to the platform without written permission from MilkSage
• Interfere with or disrupt the integrity or performance of the platform or its users

MilkSage reserves the right to investigate suspected violations of this section and to take appropriate action, including immediate account suspension or termination.

10. Intellectual Property

10.1 MilkSage Ownership

The MilkSage platform, including its software, design, features, interfaces, logos, and all related intellectual property, is owned exclusively by MilkSage. Nothing in these Terms grants you any ownership interest in the platform.

10.2 Your License to Use

Subject to your compliance with these Terms and payment of applicable fees, MilkSage grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for your internal farm management purposes.

10.3 Feedback

If you submit suggestions, ideas, or feedback about the platform, you grant MilkSage a perpetual, royalty-free license to use that feedback for any purpose, including improving the platform, without any obligation to compensate you.

11. Termination

11.1 Termination by You

You may stop using MilkSage at any time. If you wish to delete your account and farm data, contact admin@milksage.com with a deletion request. Data deletion will be processed within 14 business days.

11.2 Termination by MilkSage

MilkSage reserves the right to suspend or permanently terminate your account, with or without notice, under the following circumstances:

• Non-payment of subscription fees following the expiry of the free trial or an active subscription
• Violation of any provision of these Terms
• Misuse of the platform including but not limited to creating multiple accounts to abuse the trial system
• Abusive, threatening, or harassing behavior directed at MilkSage staff or other users
• Any use of the platform for illegal activities, fraud, or activities that cause harm to others
• Any action that compromises the security, integrity, or availability of the platform

11.3 Effect of Termination

Upon termination, your access to the platform ceases immediately. Your data will be retained for 90 days following termination, after which it may be permanently deleted. MilkSage is not liable for any loss resulting from account termination carried out in accordance with these Terms.

12. Disclaimer of Warranties

MilkSage is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MilkSage makes no warranties, express or implied, regarding the platform, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the platform will be uninterrupted, error-free, or free of harmful components
• Guarantees regarding the accuracy, completeness, or reliability of any data, calculations, or recommendations produced by the platform

Farming decisions, veterinary decisions, financial decisions, and operational decisions made based on data or outputs from MilkSage are made entirely at your own risk. MilkSage is a record-keeping and management tool and does not constitute professional veterinary, agricultural, financial, or legal advice.

13. Limitation of Liability

To the fullest extent permitted by applicable law, MilkSage's total liability to you for any claim arising from or related to your use of the platform — regardless of the basis of the claim — shall not exceed the total amount you paid to MilkSage in the twelve months immediately preceding the event giving rise to the claim.

MilkSage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of livestock, agricultural yield, or farm production
• Loss of data beyond the retention obligations stated in these Terms
• Business interruption or operational losses

This limitation applies regardless of whether MilkSage was advised of the possibility of such damages.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from or related to these Terms or your use of MilkSage shall first be attempted to be resolved through direct communication with MilkSage at admin@milksage.com.

If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of Multan, Pakistan. As MilkSage expands globally, governing law provisions for users in other jurisdictions will be addressed through updated Terms applicable to those regions.

15. Changes to These Terms

MilkSage reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you by:

• Displaying a prominent notice within the platform, and
• Sending a notification to your registered email address

Your continued use of the platform after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree with updated Terms, you must stop using the platform and may request account deletion.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and MilkSage regarding your use of the platform. They supersede all prior communications, representations, or agreements between us relating to this subject matter.
